Each project is developed based on clear briefs and collaborative work with our clients, where the scope, timelines, deliverables, adjustments and fees are defined in advance, always striving for transparent, conscious and careful management.
Our products and services combine design, manufacturing and support processes. For this reason, some are developed on demand or in limited series, taking care of every detail from the outset.
In design services, Kontento® retains its moral rights as author in accordance with the law. Economic rights are transferred to the client once the project has been paid for in full, under the terms, uses and scope previously agreed upon.
Our products are original creations of the studio, protected by current legislation. We deeply value respect for design, authorship and creative work, both our own and that of others.

1. General information

Accessing, browsing and using the website, as well as requesting information, contracting services or purchasing products, implies express acceptance of these Terms and Conditions.
2. Use of the website
The content of this site is informative and commercial in nature and presents the services, products, projects and working approaches of Kontento®. The user agrees to:
Make respectful, responsible and lawful use of the site.
Respect the content, designs, texts, images and materials protected by current legislation.
Not use the site in a way that affects its operation, security or integrity.
Kontento® makes reasonable efforts to keep the information up to date, without guaranteeing the absolute absence of typographical or technical errors.
Kontento® may update, modify or remove content from the site at any time, informing users in a clear and transparent manner.
3. Sales methods
Kontento® offers its products and services through two methods:
Assisted sales, through quotations, direct contact and personalised support, especially for design services and customised projects.
Electronic sales, through shopping carts and online payment, via third-party technology platforms. In these cases, the sales contract is finalised once payment is confirmed electronically.
Online payments are made through third-party technology platforms that facilitate the transaction.
4. Design services
4.1 Scope
Kontento®, through its Kontento Design® studio, offers professional design services, including:
Brand and visual identity design.
Naming.
Packaging design.
Industrial product design.
Social media content design and management.
Custom-developed special projects.
Each service is provided under conditions previously agreed upon through a commercial proposal, quotation, or contract.
4.2 Client information and collaboration
The client agrees to deliver the required briefs, inputs, information, and approvals in a timely and complete manner. Failure or delay in this delivery may affect the project timeline without constituting a breach by Kontento®.
4.3 Creative process and adjustments
Each proposal includes a defined number of adjustments, indicated in the quote. Additional requests or changes that exceed the agreed scope may involve additional costs and time, which will be communicated and agreed upon in advance.
4.4 Delivery times
Delivery times are estimates and correspond to a best-efforts obligation, given the creative nature of the service. Any adjustments will be communicated in a timely manner.
5. Intellectual property
5.1 Moral rights
Kontento® permanently retains the moral rights to all works, designs and developments created by its creative team, which are inalienable and cannot be waived.
5.2 Economic rights in services
Unless expressly agreed otherwise, the economic rights to the final designs are transferred to the client once the project has been paid for in full, limited to the defined uses and scope. Exclusivity is not understood to be granted unless expressly agreed.
Kontento® may include the projects developed in its professional portfolio, website or social networks, unless there is a prior confidentiality agreement.
5.3 Know-how and non-transferred materials
The transfer of rights does not include methodologies, internal processes, work systems, creative strategies, sketches, unselected proposals or know-how, which remain the exclusive property of Kontento®.
Proposals, concepts or designs that have not been contracted or paid for may not be used, reproduced or adapted in whole or in part.
5.4 Own products and developments
The products marketed by Kontento® are original creations of the studio, developed and protected in accordance with current regulations, including industrial design registrations and, where applicable, patents.
6. Kontento® products
Kontento® products are designed by the studio and manufactured in short series, combining carefully selected craftsmanship and production processes.
Due to their nature, they may present slight variations inherent to the materials used, which is part of their character, authenticity and value.
The images published are for reference purposes and seek to faithfully represent each product, without prejudice to consumer rights under the law.
7. Prices, payments and invoicing
Prices are expressed in Colombian pesos and include applicable taxes, unless otherwise indicated. Shipping costs are reported before completing the purchase.
Online payments are made through third-party technology platforms. Kontento® does not store sensitive financial information about users.
Invoicing is carried out in accordance with current Colombian legislation. For electronic sales, the electronic invoice will be sent to the email address provided by the customer.
8. Right of withdrawal
In accordance with Law 1480 of 2011, for purchases made by electronic means, the consumer may exercise the right of withdrawal within five working days of delivery of the product.
The right of withdrawal does not apply in the following cases, in accordance with the law:
Services that have begun to be performed with the consumer's authorisation.
Products manufactured according to consumer specifications or clearly personalised.
Products that, by their nature, cannot be returned or may deteriorate rapidly.
To exercise the right of withdrawal, the consumer must contact Kontento® via the contact email address. The product must be returned in the same condition in which it was delivered. The transport costs associated with the return shall be borne by the consumer.
9. Changes and returns of physical products
Kontento® accepts returns of defective and non-defective products purchased through electronic channels, in accordance with Law 1480 of 2011.
The customer may request a return within five (5) business days of delivery of the product, provided that it is unused, in perfect condition and in its original packaging.
The transport costs associated with the return will be borne by the customer, except in cases of manufacturing defects, in which case Kontento® will bear these costs.
Returns do not apply to products manufactured to custom specifications or to services that have already begun.
Exchanges are subject to inventory availability and the same conditions applicable to returns.
10. Shipping
Kontento® ships through national and international carriers.
Delivery times are counted from the business day following payment confirmation. Given that products are manufactured in short runs, the estimated delivery time is seven to fifteen business days, which may vary for production or logistical reasons, which will be communicated in a timely manner.
The product may be received by any adult present at the delivery location.
If there is evidence of damage to the packaging, this must be recorded on the carrier's delivery note and reported to Kontento® within twenty-four hours.
11. International sales
In international sales, the customer acknowledges that taxes, duties or customs charges determined by the country of destination may apply, which are not included in the price and will be borne by the buyer, unless expressly agreed otherwise.
Unless otherwise agreed, the risk of the products is transferred to the customer once they are delivered to the carrier.
International payments may be subject to bank charges or exchange rate variations.
In the event of translations of these terms, the Spanish version shall prevail for legal purposes, unless otherwise provided by applicable regulations.
12. Liability
Kontento® shall not be liable for the misuse of the products, designs or content, nor for applications or interpretations other than those expressly agreed upon.
Our commitment is to accompany each process with care, clarity and professional judgement.
13. Modifications to the terms
These Terms and Conditions may be updated at any time. The current version will always be the one published on this website.
14. Applicable legislation and dispute resolution
These Terms and Conditions are governed by Colombian law.
Any dispute shall initially be dealt with through conciliation mechanisms, with priority given to the Cali Chamber of Commerce. If no agreement is reached, the dispute shall be submitted to the competent courts of the Republic of Colombia.
